General
This is an agreement between Questionmountain (hereafter called 'QM'), and users of our website, (hereafter called 'users, 'you' or 'your'). QM is a company involved in imparting test-preparation guidance for its users using web technology based testing algorithms.Once you use our services or make a payment, it is assumed that you have read through and have accepted the terms and conditions as set forth here. We may alter the terms of this contract at any time by posting the updated terms on our site. The latest date of update will be visible as shown above and it would be your responsibility as the user to review the updates as and when you log in to use our services. A latest copy of the user agreement can be requested at any time by emailing us at admin@questionmountain.com. These terms and conditions document constitutes the entire contract between the user and QM and supersedes all previous representations, oral or written. This agreement is governed by the laws of the State of Massachussets, USA, without respect to its conflict of laws principle. Jurisdiction for any claims arising out of this agreement shall exclusively lie with the federal or state courts within Massachussets, USA. By using our sites, you confirm agreement to this privacy policy. If you do not agree to this policy, please do not use our services. QM encourages you to periodically review the Privacy Policy.

This privacy statement discloses the privacy practices for QM. If you have questions or concerns regarding this statement, you should contact admin@questionmountain.com.
QM is strongly committed to protecting the privacy of individuals who use our Web sites. In order to maintain records, we must obtain certain personal information about you. This information typically includes some or all of the following: name, address, e-mail address, credit or debit card number (including expiration date and cardholder name), institution and stage of training. In addition, we may request certain optional information about you in order to enhance our services further, to help you use our services more effectively and/or to inform you about additional services that may be of interest to you.
Other information that is stored for future use by QM includes, but is not limited to, test information providing a comparison scale for future users. This will not utilize individually identifiable information.
Disclosure of Information to Third Parties:
QM will not willfully sell or disclose your customer identifiable information with third parties (without your consent), except as required by law or to respond to a subpoena or other valid governmental order. We may share demographic information for marketing purposes, but this information is not linked to any personal information that can identify you. In addition, QM may use customer identifiable information to investigate and help prevent and prosecute unlawful activity or activity which threatens our Web site or our users' privacy or otherwise violates these terms and conditions.

This website uses google analytics and adwords advertizing features. Cookies (such as the Google Analytics cookie) or other first-party identifiers, and third-party cookies (such as Google advertising cookies) or other third-party identifiers together may be transmitted to Google. Visitors can opt-out of the Google Analytics Advertising Features using the opt-out options available at https://tools.google.com/dlpage/gaoptout/
Security:
QM is committed to protecting your personally identifiable information. We will take reasonable precautions to protect this information from loss, misuse, unauthorized disclosure or alteration, including, putting in place appropriate physical, electronic and administrative procedures to safeguard and secure such information. The passwords are encrypted and can only be changed by the user by answering previously recorded security challenge questions.
Email or other contact information :
In the ordinary course of our business, we will use the contact information you provide us regarding confirming or otherwise communicating about payment transactions. You would also be reminded of upcoming subscription expiration and renewal options. Other areas of communication could include information of new or additional services offered by QM. Such notifications will have the option of opting out of the email. Users may also contact QM via e-mail at admin@questionmountain.com to opt out of receiving notifications about new or additional services.
If you have submitted incorrect personally identifiable information through our Web sites and would like to revise this information, you may make appropriate revisions within the My Account sections of your user account.

Technical
QM will use reasonable efforts to keep its site online at all times. The user understands however that scheduled maintenance and server related problems out of the control of QM can cause the site to malfunction without prior notice. QM would not be held liable to resultant damages other than for refund on a pro-rata basis for the remaining subscription period.
System recommendations
The following are the system requirements recommended to access the licensed material. Use of non-recommended software may result in malfunctioning of the content material. Please note that the consequences of malfunctioning are guided by the disclaimer section above.
Operating system recommendations include Windows 7/8, Windows ME, NT, 2000, XP or Vista, Java runtime Environment (JRE) 1.5 or higher for windows, and the following web browsers- Internet explorer 6.0 or higher, Mozilla firefox 3.0 or higher. Hardware recommendations are for Pentium III or equivalent or higher processor, and a RAM of 128 MB or more. A high speed internet connection is preferred.
The software has been tested in a variety of computer configurations. However, due to the wide variety available, it is impossible to test on every configuration options. We do not guarantee the consistent operation on every available option.
Subscription
Various subscription schemes are available in the website. Acceptance of contract for the various schemes limits your access and use of the material to the period of time and the nature of content stipulated for that particular subscription option. It is a breach of contract to access unsubscribed content or to use it over the stipulated time period. At the end of the subscription period, your account will expire and all the personalized information (including, but not limited to, username, password, registration data, personalized notes and previous test scores) could be permanently lost.
Once you have entered the contract, refunds will not be normally granted. It remains in the discretion of QM to allow refunds in extra-ordinary circumstances. If for whatever reason, the contents or other services become unavailable due to withdrawal or other malfunctioning of the website, no redress against QM will be available other than refund for the time remaining on the subscription on a pro-rata basis. If the unavailability of services is due to the user not meeting the software/ hardware requirements contained in this document, such refund could be denied.
The username and password selected in the registration form would be the user's responsibility to secure. Unauthorized use of username/ password by third parties constitutes a breach of contract. It's use by unauthorized third parties could result in legal action against the registered user or the third party or both. The accuracy of information entered in the registration form is also the responsibility of the user. It is the user's responsibility to complete your registration accurately, in order to receive notification of QM updates, editorial and technical support.
All the material in the website including the content, data, policy documents, software and test-taking algorithms are the property of QM. Unauthorized use or reproduction, copying, resale, sublicensing, modifying or reverse engineering of this software is unlawful and would be legally pursued. You may not use any device, software or routine to cause improper functioning of the website. The licensed software can be accessed only after logging in as a registered user.
QM reserves the right to monitor user accounts for multiple simulataneous logins and to legally challenge and penalize such use. In addition, breach of contract due to any reason would be grounds for early termination of this contract without refund. We also retain the right to sue and utilize other remedies available under law on grounds of breach of contract under such circumstances.
QM could impose system restrictions while using our website to prevent unauthorized misuse of our material. The user understands the importance of this and agrees to it. To resume normal functionality, please log out of your account.
The user generated data, which includes, but may not be limited to, user generated notes, scores, passwords and registration form information is available only for the stipulated period of subscription and would expire at the end of the subscription period. Premature loss of such data due to software or hardware related issues or other reasons are not the liability of QM.
Limitation of liability
QM specifically disclaims any liability (contract, tort, strict liability or otherwise) for any incidental, indirect, special or consequential damages arising out of or in any way connected with the use of our services, even if QM has been advised of the possibility of such damages including liability associated with any medical malpractice or hardware/ software related damage or malware arising from the use of our services. QM’s maximum liability arising out of or in connection with the use of its services and site, regardless of the cause of action will not exceed your subscription fee.
